Ask your Lawyer about a Caveat on the property. It will nicely put a spanner in the works until the fencing dispute is settled; they will not be able to proceed with the transfer to the new owner.
I wore one once when trying to purchase a property. Through no fault of mine by the way. Took me a few years to get it removed, but I persevered where others wouldn't, and ended up owning the property at the original price.
