Hello People
It's been a VERY long time since I've been on here!! Life happened, we moved, we moved again, and then..... we moved back(ish).
Anyhoo...... why I'm posting.
I have/had an ex-tenant from about 8 years ago who owed me $'s...... same old, same old?? eh?? .... after two years, I finally managed to track her down and got an AO against her benefit.
She was consequently off/on/off/on (ad infinitum) her benefit. I was granted the princely sum of $10/week for debt recovery ...... BUT WAIT!! that was reduced to $5/week "... because she was on the benefit!...."
*sigh*
today I received from TINZ the following -
The debt is now over 6 years old because the fn MOJ only award $5/week, and is now >$1K. I will now have to pay $560 to get the Original Enforcement Order extended PLUS pay $50 per every address they search.
As this tenant has had more addresses than I've had hot dinners, this amount will accumulate very quickly!!
Don't know that I'll proceed tbh.
And as I haven't been on here for such a long time, I apologise in advance if this topic has already been covered.
Quite frankly the system sucks.

Enforcement Action initiated
You will recall we have started enforcement on this person but she went off the benefit.
Viability of Enforcement & Age of Debt
There are new enforcement options as of 14.4.14 which mean that we can apply for an attachment order (at a minimal repayment rate) without a hearing or by way of a phone financial assessment as long as we know their income source.
Judicial Waiver to extend enforcement time.
As the original Court order is older than 6 years we will have to apply for a waiver of the maximum period for enforcing debts before we can continue with enforcement
There are extra costs of making the application, on top of the costs any new enforcement, which are:-
- $250 Court filing fee; and
- $310 solicitor's preparation of the application.
This is due to the fact the application must be put before a District Court Judge for the granting of such a waiver. Please note the extra costs are mostly added to the debt but it is at the Judge's discretion. The billing option you chose didn't cover the costs of such an application.
Now we also have to pay the Courts $50 for every new address we want them to visit to carry out enforcement processes for us but then only one $50 fee is added to the debt.
