Overlooked lease renewal by tenant and landlord a year ago! what's the deal?

    The ADLS requires the tenant to give three months notice if the tenant wants to renew, not three months notice to avoid an automatic renewal. The Property Law Act at s.261 and 264 has provisions covering where the tenant has failed to give notice renewing for this very reason....

    If you want to argue a tenant has renewed, you need to look at something else that indicates the intention of both parties that the lease be regarded as renewed, or some conduct that "estops" the tenant from claiming it did not renew.
