  • Retrospective resource consent

    We've done some minor earth works (recontouring) and have found out from council that it was within a 1:100 flood plain and so needed resource consent. Has anyone had experience with resource consent after the fact? Cheers

    But seriously;

    1) Read the district plan and make sure the council are correct in this.
    2) Are the council actually saying you need resource consent? Is this before they will give you CCC on a house build or something?

      We're applying to build an extension (not in the flood zone) and the council planner has noted that the contours differ from the records.

        Ok, so do 1) above, and if they have the right to do it, you'll probably have to do it.

          check the rules

          I doubt it is because it is in a flood plain. More likely a rule about exposing more than a certain m2 of earth during an excavation

          The rule is designed to ensure that there is appropriate sediment controls during building work but if the work is done and no harm done then perhaps Davos first suggestion is the right one!

          Is the work obvious and or recent? Can you say it must have been landcscaping done by a previous owner? (or the council records are wrong?)

          Get some advice from a independently thinking consultant planner. What area is this in?
