Been a long time reader, but now need advice. Recently we entered into a lease with a landlord who also done some work as part of our fit-out. Problems cropped up in the first couple of weeks of operation with respects to some of the work he done for us. Example (Over charged us labor hours) Recommended things we needed when we didn't and failed to provide us with a certificate of compliance with respects to the work he done. He has also been harassing staff members in uniform, by pulling up to them in his van tooting the horn and then giving them a nice finger gesture.
We tried to raise a dispute in which he refused to listen and has since gone around his local community (Our Area) Urging people to stay away from our business, making false slanderous claims and running us down left right and center.
We have always paid our lease on time, but have noticed since he has been bad mouthing us a huge decline in sales. We have had customers come in stating they have been told by this landlord we are rip offs, and we don't pay our bills (WHICH is false) as rent is paid on time every-time. The only thing we have not paid for is the work he has done as we have a dispute due to his work not being up to our standard, and also a health and safety issue.
The lease we signed was a basic lease LONG TERM as at the beginning we trusted him, but have since found out what he has been doing. We have one written statement from a customer who wrote to our business outlining she overheard this man running our business down and telling people to stay away. Would this be enough to file a dispute to terminate the lease.
We have had enough of him, he has done damage to our sales by bad mouthing us all over the place and we just want to get out of his shop and relocate the business. Does anyone know if we can terminate, or get out of the lease in anyway?
