    That'll take a bit of digging which I have done in the past. Delivery of items by normal email does not fully comply with the ETA

      Reading the ETA, it looks like if the tenant has put down an email address as an address for service, the time of receipt is the time that the tenant's mail server receives the email (which is usually within seconds of you sending the email). The mail server usually belongs to their ISP or is gmail/hotmail etc. There doesn't appear to be a requirement that the receiver download or read the email. Using something read receipts or open tracking like contactmonkey just helps prove that they read it.

      11Time of receipt

      • An electronic communication is taken to be received,—
        • (a)in the case of an addressee who has designated an information system for the purpose of receiving electronic communications, at the time the electronic communication enters that information system; or

        • (b)in any other case, at the time the electronic communication comes to the attention of the addressee
