I was wondering if someone can advise me on this situation....
If a private landlord passes away, who acts as landlord going forward?
My mum passed away recently and our old family home is currently rented out (she was in a resthome). I am one of two executors of her estate. Would I automatically assume the role of landlord in this case? The reason I ask is that my family now require the tenants to vacate the property so that it can be prepared for sale as per her will. This requires a Notice To Vacate to be issued shortly.
The tenants are aware she has passed away, so does a 'change of landlord' notice need to be served before any other notices are issued by me? Or would a reasonable person understand that the estate executors have power to act on behalf of a deceased landlord without 'change of landlord' notice being issued?
