  • The Limitations of Building structures on cross lease sites ?

So you cant build anything on common area's.
But what about area's that are designated for you.
Say a common drive goes right past the front and side of your property.

Can you build a fence on your designated area, along the boundary of the common area driveway ?

It depends on the terms of your cross-lease, but generally for a fence (or other structure) you can build it but only with the consent of the other owners (which usually can't be unreasonably withheld).

For various reasons I’m a fan of cross-lease properties. The short answer is – yes. The only limitation is owners make collectively decisions, but also that shouldn’t be a problem as long as improvement increases the value of the entire property for everybody.
In terms of costs –the party who has the benefits normally pays. It would be very unlikely that the lease paper excludes improvements.
