  • Burglary damage - who pays?

    Hi

    Who pays the excess for damage to premises caused during an attempted burglary? The lease is a standard ADLS lease.

    Thanks for any advice.

    I presume you are talking residential, not sure about commercial but.....

    The owner of the property/the owner of the policy/the person who pays the premium will also pay the excess.

    If there are extreme circumstances, you may be able to claim the excess back from the tenant but I would doubt it.

        ADLS is a commercial lease Aston and this is placed under Commercial property. Interesting question tho.

          the lease specifies this doesn't it?
          number 5 of outgoings (5th edition)
          5. Any insurance excess (but not exceeding $2000) in respect of a claim and insurance premiums and related valuation fees.


          so the tenant pays
