There is another problem with the a fault/litigation-based approach to injury compensation: your ability to get the costs of your injury covered are dictated not solely by your level of injury, nor even by your level of need, but by the wealth of the person liable for the injury.
If you're hit by a car, your injury will be just as bad and your treatment costs and losses due to time of work etc., will be just the same, regardless of whether you're hit by someone rich as Croesus, or poor as a church mouse. If you're hit by Croesus, great, s/he can afford to pay your losses. If you're hit by the church mouse, too bad.
Yes, you can assure against that, but again, if you're a church mouse yourself, you may not be able to afford decent or reliable insurance, and although your financial losses from lost work might be less, your medical costs will be just the same as if you were wealthy.
Overall, a system where your ability to recover financially from an accident is dependent on the wealth of the person at fault, is not a good or fair system.
Every one in Ireland has to have vehicle insurance and instead of making insurance cheaper it is horribly expensive plus they don't have an ACC scheme so if you are in the wrong your insurance has to cover the injured party's costs. My third part insurance on a thousand euro car was 1500 euros my bother with a cheaper car but who was under 25 was 3000 for third party.
The other issue is you will still have to prove they were in the wrong.
as an expat with an outsiders view point ACC is Broken. It was good but has been broken by politicians. Too many People have to fight ACC to get support. Why should the victims fight? ACC is a moral hazard a boy racer can injure some one......and while the victim has years of recoverer the boy racer in comparison gets off "Free". Nzers hare paying out for bad breast implants...why isn't the manufacturer and suppliers being sued ( even if ACC did the sueing would be an improvement) as they are in other countries: the no fault clause. Foreign drivers a killing people on NZ roads and what do judges award The best I have seen is NZ$15000.00 that doesn't cover funeral costs these days!!! Foreign drivers have insurance ( well they should have) they should be become liable for the damage they cause why should the tax payer cover the costs?. Comparing to america is a losers argument. You need to compare like with like....either the UK or Mainland Europe

Well, in the UK, as in Ireland, because vehicle insurance is compulsory, it's extortionately expensive. And judging by the ads on the radio, they're doing their best to build a litigation culture, they just need a bit more time to get there.
