As far as evidence goes, I think we're mostly on the same page. i.e. There's a difference between evidence and anecdote. I've certainly heard plenty of landlords expressing frustration at TT outcomes. That's not the same thing as evidence that they were treated unfairly, because a) I'd need to review each case on its merits (including the tenants' point of view) to see whether I thought they were treated unfairly or whether they were just unhappy with the outcome (which is not the same thing); and b) even if I decided that those cases had seen the LLs receive unfair outcomes, more work would need to be done to determine the cause, whether it was the RTA, the TT system, particular adjudicators, or some other issue; and I'd also want to look at whether unfair outcomes were more likely for LLs than for tenants before I could say that the system was biased in favour of either party and/or poorly adjudicated.
The same would all be true for tenants as well.
So I'd call it hearsay on each side, but short on what I'd count as evidence.
Keys, I'd love to know (though I assume the figures aren't available) which way the decisions went in those cases. I'm picking that most of the LL applications are for unpaid rent at the end of a tenancy, and that therefore they mostly win. I'd be curious to know what tenants mostly complain about, and whether they mostly "win" or mostly "lose".
