This has been handled badly by all concerned especially Craig.

If he had done regular property inspections he should have picked this up and nipped it in the bud early.

Too late to let a year go by and then complain.
As for the no show at the tribunal, you are just asking for trouble.

The other side of the coin is the rubbish program that fair go has become. Talk about unbalanced.
No wonder no one will turn up now to be interviewed.

He didn't send the bond in or take the tenants to tribunal to get a ruling for damages before their money.

Talk about shooting yourself in the foot.
Quite rightly he's going to get hammered - and it's all his own fault.

I think its more of this governments control freak nature that the new rules have been bought in not because of one hopeless landlord.

We seem to be developing a culture in this country that the small guy is always right.

The tribunal worked fine in this case. Criag just did not have his act together and paid the price.

I would love to take some of my ex-tenants to fair-go ! Would make great telly look at the dog crap they left in the house the rent they didnt pay the damages they did and now they run away and hide so I have to spend more time and money chasing them !

Pitty fairgo only looks after the poor troden on tenants not the near bankrupt struggling landlords

I didn't see the story but if the girls ruined the floor with stilletos, they should pay for it.

I think the previous tenants said the floor was damaged by stilletos before they moved in.
So Craig was just looking for a scapegoat.

It also seems dumb to have old polished/varnished floorboards in a rental and expect them to stay pristine.
How many tenants take their shoes off inside?
Dents to the wood just adds to the charatcter - never sand them back to the pristine look.
But each to their own.

I know heaps of people

of many different ethnicities who don't wear shoes inside and, as I'm a PM, many of then are tenants. I also don't wear shoes inside and I'm as white as they come.

From what I understood of the Fair Go article, was that a Bond was taken by the LL and NOT lodged at Bond Centre.

When tenancy ended, LL took outgoing tenants to TT claiming for floor. At the TT, previous ex-tenants to the one making the claim, vouched that the floor had been in that condition when they had moved in and out of the property. LL was just trying it on. LL was ordered to return non-lodged Bond - and didn't.

Tenants aunty took up the case and eventually it went to Fair go, which is where we all saw it.

This is another example of a bad LL giving all LL's a bad name. *sigh*

Stiletto heel damage update

An update on a story a couple of weeks ago when Christine Williams of Wellington raised an interesting issue. Are stiletto marks on a wooden floor fair wear and tear? She was in a battle with letting agent, Platinum Rentals, who were refusing to return her nieces' $800 bond.

Most of you thought stiletto damage wasn't normal wear and tear. But the key issue was that the owner of Platinum Rentals, Craig Relph, refused to pay back the bond despite being ordered to by the Tenancy Tribunal. Instead he took the Williamses to the tribunal in a separate case demanding two and a half thousand dollars compensation.

The tribunal has now dismissed that second case making the following points:
The tenant who lived in the property immediately before the Williamses gave evidence that the floor, and the flat in general, were in pretty bad state. Against that background, it would not be appropriate to make an order against the tenants.

Platinum Rentals Ltd had never lodged the bond with the bond processing centre. The tribunal described this as "a matter of grave concern given Platinum's a very large landlord". This was not the first case in which Platinum Rentals hadn't lodged a bond.

The tribunal said it was also concerned that Platinum Rentals had ignored its order of 1 May 2008 and failed to repay the $800 bond. This meant the tenants had to apply for enforcement through the collections department who'd been unable to track down platinum rentals.

The Tenancy Tribunal said it would be deeply concerning if Platinum Rentals was providing incorrect information to the collections department about its address for service.

We recommend you be very careful in your dealings with Craig Relph and Platinum Rentals Ltd.

Another clear example of a sloppy and in this case arrogant "landlord" getting their just desserts.

I mean, not paying in the bond is bad enough, but ignoring the TT order? How the hell did he think his subsequent application would stick?

G
